1. Acceptance of Terms

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree, do not use the Service.

2. Acceptable use

You may use GenWeather to search locations, view forecasts and related informational tools, and contact us through provided forms, subject to these Terms and applicable law.

You agree not to:

• Scrape, harvest, or bulk-download content or weather data in a way that overloads or circumvents the Service.
• Bypass, probe, or interfere with rate limits, security controls, authentication, or access restrictions.
• Use automated systems to send abusive traffic, spam Contact submissions, or disrupt availability.
• Misrepresent your identity or the source of submissions.
• Attempt reverse engineering of non-public systems except to the extent such restriction is prohibited by law.
• Use the Service for unlawful, harmful, fraudulent, or infringing purposes.
• Republish GenWeather branding or page designs in a misleading way that suggests endorsement without permission.

3. User responsibilities

You are responsible for:

• How you interpret and act on weather information, maps, and planning suggestions.
• Complying with local laws and official safety guidance when traveling or spending time outdoors.
• Keeping devices and browsers reasonably secure when submitting forms.
• Ensuring information you submit through Contact or other forms is accurate and lawful.
• Not uploading malware, unlawful content, or others' personal data without a lawful basis.

Site administrators who install GenWeather plugins are responsible for configuring API keys, hosting, email delivery, backups, and legal notices appropriate to their jurisdiction.

4. Intellectual property

The GenWeather name, logos, page layouts, original copy, software code, and design elements of the Service are owned by GenWeather or its licensors and are protected by intellectual property laws.

Weather observations and forecast values remain subject to the rights and terms of upstream data providers. Map tiles and open data may be subject to third-party licenses (including OpenStreetMap contributor terms where applicable).

Except for the limited right to use the Service as offered, no license is granted to copy, modify, distribute, sell, or create derivative works from GenWeather software or branding without prior written permission.

5. Service changes and availability

We may modify, suspend, or discontinue features at any time, including search, maps, planning tools, or landing pages. We do not guarantee uninterrupted uptime or that every location will always return live weather.

6. Limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENWEATHER AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

WHERE LIABILITY CANNOT BE EXCLUDED, OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. MANY CONSUMERS USE THE SERVICE WITHOUT PAYMENT.

7. Indemnification

You agree to defend, indemnify, and hold harmless GenWeather and its operators from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

8. Governing law

These Terms are governed by the laws applicable to the operator of this website, without regard to conflict-of-law principles, except where mandatory consumer protections in your country require otherwise.

9. Changes to these Terms

We may update these Terms periodically. The "Last updated" date will change when revisions are published. Continued use after changes become effective constitutes acceptance of the updated Terms.
